Employer News | Department of Labor publishes new rule on classification of employees and independent contractors

The U.S. Department of Labor officially proposed a rule today that was first made public earlier this week, seeking to replace a Trump era regulation that made it easier for workers to be classified as independent contractors. The proposed rule has been highly anticipated and restores the previous control tests that equally weights six criteria in determining whether a worker is appropriately classified as an independent contractor or an employee.

Two years ago, California’s voters supported a statewide ballot (Prop 22) measure largely funded by the rideshare industry seeking relief from classifying their drivers as employees. That ballot measure remains tied up in the court system.

The Biden Administration estimates that implementation of this proposed rule will cost $188 million while some employer groups argue that it will be prohibitively expensive to change practices.

Must Read | Employers must post salary ranges under new California law

Ethan Baron in the East Bay Times: California employers will soon have to post salary ranges in job listings, under a state law intended to address unequal pay for women and minority groups.

“Studies show when there is no pay range, men are more likely to ask for more money than women are,” said San Francisco employment lawyer Jahan Sagafi.

The law also creates a new mandate for employers to disclose to existing employees the pay range for their jobs, if they request it. And it requires businesses to report new salary and wage data to the state’s Civil Rights Department.

The new law makes California the largest U.S. state to require public disclosure of pay scales in job postings.
